Sales Deed Registration Process in Maharashtra — Step by Step

What is a Sale Deed?

A sale deed is the primary legal document that transfers ownership of immovable property from the seller to the buyer. Without a registered sale deed, the transfer of property is not legally complete in the eyes of the law. In Maharashtra, sale deeds are governed by the Transfer of Property Act, 1882 and the Registration Act, 1908.

The sale deed must be registered at the Sub-Registrar Office (SRO) of the jurisdiction where the property is located. Failure to register makes the sale void against any subsequent buyer.

Step 1 — Verify Title and Obtain Documents

Before drafting the sale deed, the buyer should verify clear title:

  • Obtain the 7/12 extract (Satbara Utara) for agricultural land or property card for urban properties
  • Verify there are no encumbrances using an Encumbrance Certificate from the SRO
  • Check for any pending property tax dues at the local municipal corporation
  • Obtain NOC from the housing society if it is an apartment
  • Step 2 — Draft the Sale Deed

    The sale deed must accurately describe the property with survey number or CTS number, area, boundaries and all encumbrances. It must include the consideration (sale price), mode of payment, possession date and warranties from the seller about clear title.     Step 3 — Calculate and Pay Stamp Duty

    Stamp duty in Maharashtra is payable on the higher of the market value or the agreement value:

  • Municipal Corporation area: 5% of property value

  • Additional Metro Cess: 1% in applicable areas
  • Registration fee: 1% (maximum ₹30,000)
  • Stamp duty is paid online via the Maharashtra government's GRAS portal before registration.

    Step 4 — Book SRO Appointment

    Once stamp duty is paid, both buyer and seller must appear at the Sub-Registrar Office for registration. You will need:

  • Original and two copies of the sale deed
  • Stamp duty payment challan
  • Aadhaar card and PAN card of both parties
  • Two passport photographs each
  • Property documents (7/12 / property card)
  • Society NOC if applicable
  • Step 5 — Biometric Registration at SRO

    At the SRO, both parties give their thumb impression and photograph. The SRO officer verifies the documents and registers the deed. The registered document is typically available for collection within 2 to 7 working days.
